1. Acceptance of Terms

By creating an account or using FOGATO (“the Service”) you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

FOGATO is an AI-powered content creation platform that generates social media posts from a single prompt and publishes them to connected platforms. The Service is provided “as is” and is subject to change.

3. Accounts

You must provide accurate information when creating an account.
You are responsible for maintaining the security of your account credentials.
You may not share your account with others.
You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use the Service.

4. Acceptable Use

You agree not to use FOGATO to:

Generate or publish content that is illegal, abusive, harassing, or defamatory
Violate the terms of service of any connected social platform
Infringe the intellectual property rights of others
Send spam or unsolicited commercial messages
Attempt to circumvent rate limits or security measures
Reverse-engineer or scrape the Service

5. Content Ownership

You own the content you create through FOGATO. By using the Service you grant us a limited, non-exclusive license to store and transmit your content solely to operate the Service (e.g., to publish to connected platforms at your request).

AI-generated content does not carry copyright in most jurisdictions. You are responsible for reviewing and editing content before publication.

6. Platform Connections

FOGATO connects to third-party social platforms via OAuth. You are responsible for compliance with each platform’s terms of service. We are not liable for content removed, accounts suspended, or other actions taken by third-party platforms.

7. Subscription & Billing

Subscriptions are billed in advance on a monthly or annual basis.
You may cancel at any time; access continues until the end of the billing period.
Refunds are handled at our discretion — contact support within 7 days of a charge.
We reserve the right to change pricing with 30 days’ notice.

8. Availability & Limitation of Liability

We aim for high availability but do not guarantee uninterrupted service. To the maximum extent permitted by law, FOGATO’s liability for any claim arising from use of the Service is limited to the amount you paid in the 3 months preceding the claim.

9. Termination

Either party may terminate at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination you may export your data for 30 days.

10. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles.

11. Changes

We may update these Terms. Material changes will be communicated with at least 14 days’ notice. Continued use after the effective date constitutes acceptance.
